This website is owned and operated by Real Deal Farmacy LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors online product browsing and online ordering for pickup in-store ("order ahead"), and online scheduling of medical cannabis consultations for new and returning patients. Users can also track their rewards points in our loyalty program ("SustainableStash"). By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age for medical patients, or at least 21 years of age for recreational users, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

We are not yet open for business. Products shown on this website are for display purposes only. All product information shown may change before we officially open.

When we open, customers will use our website to browse products and create "order-ahead reservations" for in-store pickup. No payments are processed online, all transactions occur in-store upon pickup. Order reservations are processed through our third-party partner platform. Your reservation information will be shared with this platform according to their privacy policy.

All cannabis transactions are subject to Minnesota state tracking requirements. Your purchase information will be reported to the Minnesota Office of Cannabis Management and the METRC tracking system as required by law.

No cannabis purchases will be processed through this website.

Unfortunately, for safety reasons and the nature of the products dispensed, all sales for cannabis products are final.

However, for any product or accessory with a defect or issue, simply report the problem along with the original receipt within 14 days of the original date of purchase and we will help you determine if the product qualifies for an exchange or store credit. 

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Real Deal Farmacy LLC.

Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

All content on this website, including text, graphics, logos, images, educational materials, strain guides, dosing information, and the Real Deal Farmacy and SustainableStash™ branding, is owned by or licensed to Real Deal Farmacy LLC. This content is protected by copyright, trademark, and other intellectual property laws.

Permitted Use:
 

• You may view and browse our website content for personal, non-commercial use, share links to our content with proper attribution, and print individual pages for personal reference.

• You may quote brief excerpts (fewer than 100 words) in reviews or discussions with proper attribution.

Our cannabis education guides, dosing charts, and consultation materials are proprietary and for customer use only. Commercial use requires written permission. We may use licensed content from third parties and external links for educational purposes. We are not responsible for third-party website content or practices.

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.

You agree to indemnify and hold Real Deal Farmacy LLC harmless from any demands, loss, liability, claims or expenses (including attorneys' fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Real Deal Farmacy LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
 

To the maximum extent permitted by applicable law, Real Deal Farmacy LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

We use various third-party services to operate our business, including:

Your personal information may be shared with these service providers as necessary for business operations. For medical cannabis patients, we maintain Business Associate Agreements with service providers that handle protected health information, as required by applicable privacy laws.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

Cannabis remains a Schedule I drug. The cultivation, processing, sale, and possession of cannabis and products containing cannabis, the manufacture, sale, and possession of cannabis paraphernalia, and advertising the sale of cannabis, cannabis products and cannabis paraphernalia are illegal under the federal laws of the United States and certain state laws.

• Warning: Cannabis use during pregnancy and breastfeeding may be harmful.

• Warning: Do not drive or operate heavy machinery while under the influence of cannabis.

• Keep all cannabis products away from children.

• Our products have not been analyzed or approved by the FDA.

• The effects of edible cannabis products may be delayed by up to two hours.

• Cannabis consumption is restricted to private locations only in accordance with Minnesota state law.

• Medical cannabis products are only available to qualifying patients where allowed under state law.

• Special privacy provisions apply to medical cannabis users in accordance with state regulations.

• Medical cannabis products sold by Real Deal Farmacy LLC have not been analyzed or approved by the FDA.

• Medical cannabis products are not intended to diagnose, treat, cure, or prevent any disease.

Medical Cannabis Consultations: Our state-certified cannabis consultants provide product guidance and recommendations to qualifying medical cannabis patients. These consultations are educational in nature and designed to help you select appropriate cannabis products based on your healthcare provider's recommendation to try medical cannabis.

• Consultations are advisory and educational, not medical treatment

• Our consultants cannot provide medical advice, diagnose conditions, or modify healthcare provider recommendations

• Consultations do not replace the need for ongoing communication with your healthcare provider

• We may retain consultation notes for quality assurance and service improvement

• All consultation information is confidential and subject to enhanced privacy protections

• Product recommendations are based on general information and your reported preferences

• Individual responses to cannabis products may vary significantly

• Start with the lowest recommended dose and increase gradually as needed

• Consult your healthcare provider about potential drug interactions

• Do not drive or operate machinery after using cannabis products

• Cannabis products may affect pregnancy and breastfeeding

Medical Cannabis Consultation Privacy: Information collected during medical cannabis consultations is subject to additional privacy protections under our Notice of Privacy Practices.

Products sold by Real Deal Farmacy LLC are not intended for resale or interstate transport. Transportation of cannabis products across state lines is prohibited by federal law.

• Account holders must present valid government-issued identification that matches account information when picking up orders or making purchases

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Minnesota, USA, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Walker, Cass County, Minnesota, USA.
