Loyalty Program Terms

Introduction

 

These Loyalty Program Terms and Conditions ("Terms") govern your participation in the loyalty program SustainableStash™ ("Program") operated by Real Deal Med+Rec ("we," "us," "our"). By enrolling in our Program, you agree to these Terms.

 

Eligibility

 

To participate in the Program, you must:

  • Provide a valid birthdate and be at least twenty-one (21) years of age

  • Be a legal resident of the United States or Canada

  • Be legally authorized to purchase and consume cannabis in the state of Minnesota

  • Provide a valid phone number for account identification

  • Complete at least one qualifying purchase to begin earning points and unlocking rewards

 

Program membership is limited to individuals for personal use only. Business entities are not eligible to participate.

Employees of Real Deal Med+Rec may be subject to different or additional terms regarding Program participation.

We reserve the right to verify your eligibility at any time. Providing false information regarding your eligibility may result in termination of your membership and forfeiture of accumulated points.

 

Enrollment


You may enroll in the Program by:
 

  • Providing your phone number at checkout during an in-store purchase

  • Confirming your enrollment by providing required personal information

  • Agreeing to these Terms
     

By enrolling in the Program, you consent to receive communications from us regarding your account status, point balance, available rewards, and Program updates via your provided contact information.


You are responsible for maintaining the accuracy of your account information. Please notify us of any changes to ensure you receive Program communications.

 

Earning Points

 

Points are earned through the following activities:

​

  • One-time sign-up bonus: [NUMBER] points awarded upon Program enrollment

  • One-time new patient consultation check-in: [NUMBER] points awarded after completing a new patient consultation

  • Birthday bonus: [NUMBER] points awarded annually on your birthday

  • Returning single-use packaging for proper disposal: [NUMBER] points per eligible item

  • Returning reusable containers for sanitization and reuse: [NUMBER] points per eligible item

  • Seasonal promotions and special events as announced

 

Points will be credited to your account at the time of the qualifying transaction or activity.

 

Points earned through return of packaging or containers must be verified by our staff at the time of return. We reserve the right to determine which packaging or containers qualify for points.

 

You must identify yourself as a Program member by providing your registered phone number during checkout to earn points.

 

Points cannot be earned retroactively for purchases or activities completed before enrollment or for transactions where you did not identify yourself as a Program member.

 

For online or order-ahead purchases, points will be credited at the time of in-store pickup.

 

We reserve the right to offer bonus point opportunities at our discretion. Terms of such opportunities will be communicated at the time they are offered.

 

Points have no cash value and cannot be purchased, sold, or bartered.

 

Point Balance and Expiration

 

Your current point balance can be viewed:
 

  • By asking any of our staff members during an in-store visit

  • By contacting our customer service

  • Through any other methods we may provide

 

Points do not expire.

 

In cases of account inactivity exceeding twenty-four (24) consecutive months, we reserve the right to deactivate the account. Prior to any such deactivation, we will attempt to notify you using your registered contact information.

 

Any discrepancies in point balances must be reported within thirty (30) days of the transaction in question.

 

Redeeming Points

 

Points can be redeemed exclusively for discounts on qualifying purchases at our dispensary.

 

Points can only be redeemed in-store during checkout.

 

The following restrictions apply to redemptions:

​

  • Minimum point thresholds may apply for redemption

  • Point redemption may be limited or unavailable during certain promotional periods

  • Certain products may be excluded from point redemption at our discretion

  • Redemptions cannot be combined with certain other offers or promotions

  • Redemptions must comply with all applicable laws and regulations

 

Points are non-transferable between Program members.

 

Once points are redeemed, the transaction cannot be reversed.

 

We reserve the right to modify the redemption schedule, including the number of points required for specific rewards, with reasonable notice as described in Section 10.

 

Adjustments 


If you exchange a product that was purchased using a discount obtained through point redemption, the redemption will not be reversed, and the points will not be returned to your account.

 

Restrictions

 

We reserve the right to monitor Program participation and investigate any activity we consider suspicious.

 

The following actions are prohibited and may result in termination of membership and forfeiture of accumulated points:
 

  • Fraudulent or unauthorized earning or redemption of points

  • Misrepresentation of identity or eligibility information

  • Abuse of the Program, including manipulation of point systems

  • Reselling of products purchased with Program discounts

  • Any other activity that violates these Terms or applicable law

 

We reserve the right to deny, cancel, or revoke membership at our sole discretion if we suspect fraud, misrepresentation, abuse, or violation of these Terms.

 

Privacy

 

Information collected in connection with the Program is subject to our Privacy Policy, which is incorporated by reference into these Terms.

 

By participating in the Program, you consent to our collection, use, and disclosure of your personal information as described in our Privacy Policy.

 

We will maintain the confidentiality of all information collected through the Program in accordance with applicable laws.


Program Modifications and Termination

 

We reserve the right to modify or terminate the Program, in whole or in part, at any time with reasonable notice.

 

Modifications may include, but are not limited to:

  • Changes to ways of earning points

  • Changes to point values

  • Changes to redemption options and requirements

  • Changes to Program benefits

  • Changes to these Terms

 

Notice of material modifications will be provided at least thirty (30) days prior to implementation through one or more of the following channels:

​

  • Email or SMS to your registered contact information

  • Posting at our dispensary location

  • Announcement on our website

  • Any other reasonable method of communication

 

Your continued participation in the Program after the effective date of any changes constitutes your acceptance of such changes.

 

In the event of Program termination, members will have ninety (90) days from the announcement date to redeem accumulated points. After this period, all unredeemed points will be forfeited without compensation.

 

We are not liable for any losses or damages resulting from Program modifications or termination.

 

Limitation of Liability

 

The Program is offered on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

 

We are not responsible for:
 

  • Technical failures of any kind, including but not limited to electronic malfunction or damage to your device

  • Any error, omission, interruption, deletion, or defect in Program operation

  • Communications failures or errors

  • Theft, destruction, or unauthorized access to Program records

  • Inaccurate point balances resulting from system errors

 

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE PROGRAM.

 

Our total liability to you for any claim arising from or related to the Program shall not exceed the approximate retail value of the rewards earned by you during the twelve (12) months preceding the claim.

 

Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

 

Any dispute arising from or relating to the Program shall be resolved exclusively in the courts located in Cass County, Minnesota.

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

Communications and Contact

 

By enrolling in the Program, you consent to receive communications from us regarding the Program via methods including but not limited to SMS, email, or postal mail.

 

You may opt out of marketing communications while remaining enrolled in the Program, though you will continue to receive essential Program communications.

Miscellaneous


These Terms constitute the entire agreement between you and us regarding your participation in the Program, superseding any prior or contemporaneous agreements.

 

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or our right to enforce it in the future.

 

You may not assign your Program membership or any benefits thereof without our express written consent.

 

Section headings are for convenience only and shall not affect the interpretation of these Terms.
